Terms of Use

1. About FourthParty

FourthParty is a technology platform that helps mediators, attorneys, and parties efficiently manage mediation cases and connect with dispute resolution professionals.

We are not a law firm, and use of the Platform does not create an attorney-client relationship. We do not provide legal advice.

2. Eligibility

You must be at least 18 years old and capable of entering into a binding legal agreement to use the Platform.

3. Account Registration

To access certain features, you must register for an account. You agree to provide accurate information and to keep your account credentials confidential. You are responsible for all activity under your account.

4. Use of the Platform

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You will not:

  • Violate any applicable law or regulation.
  • Impersonate any person or misrepresent your affiliation.
  • Interfere with or disrupt the Platform.

5. SMS Communications 

FourthParty uses Vonage as a third-party SMS processor. By providing your mobile number, you consent to receive SMS messages from FourthParty for case notifications, reminders, and platform updates.

  • You may opt out at any time by replying “STOP”.

Your mobile information will not be shared with third parties for marketing purposes without your express consent.

6. Google Calendar 

By connecting your Google Calendar with FourthParty, you agree to the terms outlined in this section, in addition to our general Terms of Use.


1. Authorization and Data Access:
You authorize FourthParty to access your Google Calendar data, including events and calendar metadata, from the specific calendars you select for integration.
This access is granted via OAuth 2.0 authentication, and you retain control over which calendars FourthParty can access through your Google account settings.


2. Scope of Access and Use:
FourthParty's access to your Google Calendar is governed by the Google API scopes you explicitly grant during the connection process. These scopes include:
https://www.googleapis.com/auth/calendar.readonly (Allows FourthParty to see and download any calendar you can access.)


https://www.googleapis.com/auth/calendar.events (Allows FourthParty to view and edit events on all your calendars.)


FourthParty will use this access solely to provide the intended functionality of the integration, including displaying your events, allowing you to add and update events, and facilitating synchronization.


We will only sync events from calendars you specifically enable within FourthParty, and we may apply filters (e.g., from today onward, excluding certain known non-work event types) during the initial sync.


3. Two-Way Synchronization and Event Management:
FourthParty offers the potential for two-way synchronization with your Google Calendar.
Events created or added by you through the FourthParty application will be synchronized to your designated Google Calendar. If you modify these FourthParty-created events within FourthParty, these changes will also be updated on your Google Calendar.


FourthParty will never delete events from your Google Calendar that were not originally created or added through the FourthParty application.


FourthParty will only update events on your Google Calendar if those events were initially created/added by FourthParty, or if the update reflects changes made within FourthParty to an event that has been synchronized.


4. Data Accuracy and Responsibility:
While FourthParty strives to maintain accurate synchronization, we are not responsible for any discrepancies, errors, or data loss that may arise from Google Calendar API issues, internet connectivity problems, or external changes to your Google Calendar not initiated through FourthParty.


You are responsible for regularly reviewing your calendars to ensure accuracy.


5. Revocation of Access:
You may revoke FourthParty's access to your Google Calendar at any time by visiting your Google Account settings (typically under "Security" > "Third-party apps with account access").
Revoking access will disable the Google Calendar integration features within FourthParty and may remove synchronized events from FourthParty.


6. Compliance:
FourthParty's handling of data obtained from Google APIs adheres to Google's API Services User Data Policy, including its Limited Use requirements.

7. Payments 

FourthParty uses Stripe as a third-party payment processor. By making a payment on our Platform, you agree to Stripe’s Services Agreement and Privacy Policy.

  • All prices and fees are listed in U.S. dollars.
  • Payments are processed securely.
  • FourthParty does not store your credit card information.

For subscription plans, you authorize recurring charges as agreed during checkout. You may cancel subscriptions per our Cancellation Policy outlined in Section 8.

8. Cancellations & Refunds

If you cancel a mediation or subscription, eligibility for a refund will depend on the terms displayed at the time of booking or purchase. FourthParty reserves the right to withhold a portion of fees to cover processing and administrative costs.

9. Intellectual Property

All content on the Platform, including but not limited to logos, software, and text, is the property of FourthParty or its licensors and is protected by copyright and trademark laws.

10. Third-Party Services

The Platform may link to or integrate with third-party services like Stripe and Vonage. We are not responsible for their content, policies, or practices. Your use of these services is subject to their terms.

11. Termination

We may suspend or terminate your access at any time, for any reason, including violation of these Terms. Upon termination, your right to access the Platform will cease immediately.

12. Disclaimers & Limitation of Liability

The Platform is provided “as is” without warranty of any kind. To the fullest extent permitted by law, FourthParty disclaims all warranties, and will not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform.

13. Indemnification

You agree to indemnify and hold harmless FourthParty, its affiliates, and their officers, directors, employees, and agents from any claims or liabilities arising from your use of the Platform or violation of these Terms.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via the Platform or email. Continued use of the Platform constitutes acceptance of the new Terms.

15. Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to conflict of law principles. You agree to submit to the personal jurisdiction of the state and federal courts located in Fulton County, Georgia.
